4.1 You are solely responsible for any content, materials or other information you submit or upload to the Site (“User Content”). 4.2 You must not use the Site: (a) for any unlawful purpose; (b) to harm, threaten, abuse or harass others, or in a way that invades others’ privacy or rights; (c) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); (d) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; (e) in any way that is discriminatory, defamatory, obscene, offensive, pornographic, abusive, indecent, hateful, or that promotes violence or illegal activities. 4.3 We reserve the right to remove or refuse to post any User Content on the Site for any reason in our sole discretion, without prior notice to you.
Third-Party Websites
5.1 The Site may include links to third-party websites which are not under our control. We have no control over the nature, content, and availability of those websites. We do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third-party websites linked to the Site, you do so entirely at your own risk.
Limitation of Liability
6.1 The Site and all information, content, materials, and services included on or otherwise made available to you through the Site are provided on an “as is” and “as available” basis, unless otherwise specified in writing. 6.2 To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to the Site and your use of it (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose, and/or the use of reasonable care and skill). 6.3 We will not be liable to you in respect of any special, indirect or consequential loss or damage, or any loss of revenue, income, profits, contracts, or anticipated savings, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable. 6.4 Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by applicable law.
Indemnity
7.1 You agree to indemnify us, and keep us indemnified, from and against any costs, claims, damages, expenses, liabilities, and losses (including legal fees) suffered or incurred by us arising out of or in connection with any breach by you of these Terms, or any other legal obligation by you or any act or omission by you.
